Terms of service
What we undertake to do, what we cannot promise, and what we ask of you.
Last updated:
1. These terms
These terms govern the services provided by Menés Academy (“we”, “us”) to you (“the student”). By creating an account, booking a consultation or signing a service agreement, you accept them. Where an individual signed service agreement conflicts with these terms, the signed agreement takes precedence.
We work with students from many countries. Nothing in these terms removes a consumer right you hold under the law of your own country of residence.
2. What we provide
Depending on the service level you select, we provide guidance and administrative support which may include: eligibility assessment, university selection, preparation and submission of applications, document recognition coordination, scholarship filing, visa application support and arrival assistance. The specific scope is set out in your service agreement.
3. What we cannot promise
- We do not guarantee admission. Admission decisions belong to universities alone.
- We do not guarantee a visa. Visa decisions belong to consular authorities alone. We prepare your file to the highest standard we can and assist with appeals, but no agency can control or promise the outcome.
- We do not guarantee a scholarship. Scholarship awards are determined by regional bodies against criteria and budgets outside our control.
- We do not provide legal or immigration advice within the meaning of any regulated profession. Where your situation requires it, we will tell you to consult a qualified lawyer.
Any person representing that we guarantee any of the above is not authorised to do so.
4. Your responsibilities
- Provide accurate, complete and genuine information and documents. Submitting falsified documents is grounds for immediate termination without refund, and may result in a multi-year entry ban imposed by the authorities.
- Meet the deadlines we communicate to you. Where a deadline is missed because a document was not supplied in time, we are not responsible for the outcome.
- Keep your contact details current and respond to reasonable requests for information.
- Keep your portal credentials confidential and tell us promptly if you believe your account has been accessed by someone else.
5. Fees and payment
The eligibility assessment is free and carries no obligation. Fees for other services are quoted in writing before you commit and are payable in instalments tied to milestones, as set out in your service agreement. Third-party costs — university application fees, CIMEA and legalisation charges, sworn translations, visa fees, courier and travel costs — are not included in our fees and are paid by you directly or reimbursed to us at cost.
6. Refunds
Where a visa refusal or a failed application is directly attributable to an error or omission on our part in work we agreed to perform, we will refund the admission service component of our fee. Refunds do not extend to third-party costs already incurred, or to outcomes arising from information you supplied that was inaccurate or incomplete. Refund requests must be made in writing within 30 days of the decision, and we will respond within 30 days.
7. Cancellation
You may cancel at any time by written notice. Fees for milestones already completed remain payable; fees for milestones not yet started are not charged. We may terminate the agreement where a student supplies falsified documents, behaves abusively toward our staff, or fails to pay an agreed instalment after written reminder.
8. Liability
Our total liability arising out of or in connection with our services is limited to the total fees you have paid us, except where liability cannot lawfully be limited. We are not liable for indirect or consequential loss, including loss of an academic year, travel costs or accommodation deposits.
9. The student portal
Portal access is provided for the duration of your engagement and for a reasonable period afterwards. We may suspend access where an account is used unlawfully or where we reasonably suspect it has been compromised. We aim for continuous availability but do not guarantee uninterrupted service.
10. Intellectual property
Templates, checklists, written guidance and other materials we supply remain our property and are licensed to you for your own application only. You may not resell or redistribute them.
11. Governing law
These terms are governed by the law of the country in which Menés Academy is registered, as identified in your service agreement. Disputes fall within the exclusive jurisdiction of the courts of that country — without prejudice to any mandatory consumer protection available to you where you live, which these terms do not override.
Before starting any formal proceedings, we ask that you raise the matter with us in writing so that we have a genuine opportunity to resolve it.
